Before rape shield laws were enacted defendants frequently attempted to show their victims were less than chaste by presenting evidence proving the victims were sexually experienced. the tactic effectively discouraged many victims from coming forward and many rapes went unreported. Please respond to the following: Does the Rape Shield Law provide a good way to address the problem of unreported sex crimes? Does the Rape Shield Law prevemt the defendant from having a fair trial by keeping a valid part of the story from the ears of jurors? Is a person’s past sexual history relevant to his/her ability to refuse sex on any given occassion?
