You are a consultant with an environmental management firm that has a client who has the following spent halogenated solvents used in degreasing operations at their facility: tetrachloroethylene, trichloroethylene, methylene chloride, 1,1,1-trichloroethane, carbon tetrachloride, and chlorinated fluorocarbons. You have been asked to do research related to these solvents and the Resource Conservation and Recovery Act RCRA), which regulates hazardous substances. The client is concerned that the solvents used might be considered hazardous wastes, which would subject the client to regulation under RCRA. The specific issues you are required to research are:
1. What is the statutory and regulatory citation for the definition of solid waste under RCRA and its implementing regulations?
2. What is the statutory and regulatory citation for the definition of hazardous waste under RCRA and its implementing regulations?
3. Where can the standards applicable to generators of hazardous waste be found under RCRA and its implementing regulations?
4. Where can the standards applicable to transporters of hazardous waste be found under RCRA and its implementing regulations?
5. Where can the standards applicable to owners and operators of hazardous waste treatment, storage, and disposal facilities be found under RCRA and its implementing regulations?
6. What are the four characteristics of a hazardous waste and where can that be found in the RCRA regulations?
7. For the purposes of hazardous waste determination what regulation must a person who generates a solid waste use to determine if that waste is a hazardous waste?
8. What is the regulatory citation for the lists of hazardous wastes?
9. Are spent halogenated solvents of tetrachloroethylene, trichloroethylene, methylene chloride, 1,1,1-trichloroethane, carbon tetrachloride, and chlorinated fluorocarbons are any of those lists?
10. If so, what conclusion can you reach as to whether these substances are regulated under RCRA?
